How can you benefit from mediation?
A “third-party neutral,” called the mediator, helps facilitate conversations between the opposing parties as they work through their divorce agreements, asset division process, child custody concerns and spousal support negotiations. The mediator aids the parties in finding mutually amicable terms to each issue while still offering a great deal of flexibility. This allows both parties to retain more control over the outcome of their divorce and reduces time-consuming and expensive court fees.
Can you use mediation to modify existing divorce or custody orders?
Yes. When either party wants to modify an existing divorce or custody order, mediation may be used to facilitate the discussions. Because divorce and custody orders are created by a court, an agreement made through mediation must still be approved by a judge before it becomes legally binding.
Is mediation legally binding, and can a mediation agreement be enforced?
Once the agreement has been put into writing, signed by both parties and approved by a family law judge, it becomes an enforceable court order – the same as a judge’s decree.
What happens if mediation fails?
Mediation does not guarantee that parties will reach an amicable agreement. If mediation fails, the parties can try going through the process again, perhaps after a break or with a different mediator. Alternatively, the parties can settle their family law issues in court through litigation.
